Operating as a Consumer Reporting Agency (CRA) and a wholesale records provider requires a strict adherence to federal law, rigorous data engineering, and an ongoing commitment to industry excellence.

1. Our PBSA Membership & Industry Alignment

ACE is a proud member of the Professional Background Screening Association (PBSA).

The PBSA is the premier international governing body representing the interests of companies offering background screening services. As a member, ACE strictly aligns its operational workflows, data acquisition models, and client management structures with the rigid ethical and professional standards established by the association.

Our PBSA alignment ensures that:

2. The Core Pillars of Our FCRA Compliance Framework

The Fair Credit Reporting Act (FCRA - 15 U.S.C. § 1681) is the federal statute governing the collection, assembly, and use of consumer report information. ACE enforces a multi-layered compliance framework to protect consumers and shield our clients from legal liabilities.

A. Strict Client Credentialing (Section 607(a))

We do not allow anonymous or unverified searches on our platform. This includes validating business legitimacy, verifying physical office locations, and obtaining a signed contract explicitly certifying their lawful Permissible Purpose.

The FCRA requires CRAs to follow "reasonable procedures to assure maximum possible accuracy of the information." ACE achieves this through advanced data mapping and logical validation rules. We actively work to eliminate common public records anomalies—such as mismatched names or outdated court indexes—by cross-referencing identifiers before records are compiled into a final report.

C. Obligation to Update and Filter (Section 613)

For employment screening, when public records containing adverse information (like criminal filings) are routed, ACE ensures compliance by maintaining strict, real-time up-to-date lookups directly at the authoritative county or state source, or by providing immediate notification to the consumer that public record information is being reported.

3. Comprehensive Consumer Protections
Consumer Rights and File Disclosure

Under the FCRA, consumers retain absolute transparency rights regarding the data clearinghouses maintain on them. If you have been the subject of an evaluation processed or routed by ACE, you have explicit federal rights.

File Disclosures (Section 609)

Upon a verified request, ACE will provide a consumer with a complete disclosure of all information contained within their file at the time of the request, free of charge. This file disclosure includes the sources of the data and a log of any recipients who have accessed the report within the legally mandated tracking window.

The Reinvestigation & Dispute Process (Section 611)

If a consumer believes any notation within an ACE report is inaccurate, incomplete, or out of compliance (such as a sealed or expunged record under Ohio Revised Code § 2953.32), they may initiate a formal dispute.

  • The Procedure: Once a dispute is filed, ACE flags the record and initiates an expedited reinvestigation.

  • The Timeline: We contact the source repository or clerk of courts to verify the data's current state. We resolve and update or delete the contested information within the legally prescribed 30-day window, notifying both the consumer and the reviewing client of the outcome.

4. Downstream Compliance Resources for Direct Clients

For our direct business clients utilizing ACE for hiring or tenant evaluations, we build regulatory safeguards directly into our ordering interface. We provide our users with complete access to necessary compliance forms to execute their duties legally, including:

  • Standalone FCRA Consumer Disclosure layouts.

  • Consumer Authorization templates detailing state-specific rules (including unique Ohio background check disclosures).

  • The Consumer Financial Protection Bureau’s (CFPB) official document: "A Summary of Your Rights Under the Fair Credit Reporting Act."

  • Automated Pre-Adverse Action and Final Adverse Action notice tools to assist clients if a candidate is disqualified based on background results.
